Terms of Service

AGREEMENT

By visiting our site and/or placing an order with us, you engage in our service and therefore agree to be legally bound by the following terms and conditions made by Spilled Milk Company. This Terms of Service applies to all users of the site and its Terms and Conditions may be modified at any given time with no notification.

GENERAL

We reserve the right to refuse any orders and/or inquiries you place with us. In the event that we cancel your order, you will be notified ASAP via e-mail and/or phone number provided at the time the order was placed and issued a full refund automatically.

PRODUCTS AND SERVICES

You understand and accept that your cake/dessert items is not going to look exactly as the one pictured on our site and/or social media (Instagram) to the T. Inspiration photos are used as a guide. We reserve the right to have creative control on designs. Each cake is handmade and “one of a kind” with unique differences. We match custom colors to the best of our ability but can not guarantee your monitor will display the color accurately to how we see it on our monitor (computer/phone/tablet/etc). In addition, the color of your cake can look different depending on the photo, lighting, and/or surrounding environment. We reserve the right to artistic changes/freedom for each cake when necessary. Products can have price changes, be modified, or discontinued at any time without notice. We are not liable to you for any modifications, price changes, or discontinuance of products and/or services. You agree not to copy and sell any portion of our products, designs, and/or services posted on our website and/or social media (Instagram) without written consent from us.

USAGE OF NON-EDIBLE MATERIALS

Please be aware that your cake contains wooden dowels, plastic dowels, bubble straws, cardboard/wood boards in-between the layers. Please remove before consuming. Fondant decorations such as figurines may have wooden and styrofoam supports inside. Do not consume fondant figurines.

ALLERGENS

Our facility and equipment comes in contact with peanuts, nuts, soy, dairy, and other potential allergens.

PLACING DESSERT ORDERS

If your order can not be fulfilled, we will notify you ASAP via email and/or phone number provided at the time the order was made and issue a full refund immediately.

You understand and agree that Spilled Milk Company's are purchased (100% of the cost) upfront first before your order is officially confirmed. We reserve the right to refuse and cancel any order you place with us and/or limit/change order quantities placed. We reserve the right to refuse any orders/inquiries if the client is deemed unfit for our cake shop.

PRICING

We reserve the right to change our prices for our products/services at any time without notice. The price for a custom cake/dessert will vary based on the final design itself, quantity, and cake size, which will be determined by Spilled Milk Company. The price will be transparently communicated to the client.

CANCELLATIONS & ORDER CHANGES

Cancellations: Clients may cancel an order with more than 30 days advance notice from the fulfillment date for a full refund. If the order is canceled within 21 days from the fulfillment date, no refund will be issued. Order Changes: If clients want to change certain parts of their order, we require 21-day minimum advance notice from the fulfillment date. No changes can be made within those 21 days.

Date Change: Clients can change the date of cake pickup with more than 21 days advance notice ONLY to a date that comes after the original date of pickup/delivery inputted in the cake order. The date cannot be rescheduled or changed to an earlier date from the original date of pickup/delivery inputted in the cake order. Rescheduling changes cannot be made within 21 days of cake pickup/delivery.

WEDDING/LARGE EVENT CANCELLATIONS

Clients may cancel their large event order with more than 30 days advance notice from the fulfillment date for a full refund. If the order is canceled within 30 days from the fulfillment date, a 50% refund will be issued.

CAKE DAMAGES

Pickups: Spilled Milk Company assumes no liability or responsibility after the cake(s)/desserts are in the client’s possession.

Deliveries: Spilled Milk Company assumes no liability or responsibility after the cake(s)/desserts have been delivered to the delivery address provided at the time of order placement.

CLIENT FEEDBACK

If you send us comments and/or feedback, you agree that we may, at any time, publish and/or distribute any of those comments. We are not obligated to maintain any comments in confidence.

We reserve the right to update and change any part of this Terms of Service, on this page. It is the client’s responsibility to check our website periodically for any changes or updates made.
